A pre-inquest review hearing at Stockport Coroner's Court yesterday (Wednesday, October 11) heard a file has now been sent by GMP to the Crown Prosecution Service (CPS) who are to make a decision on 'whether they are going to prosecute the other driver.' The driver was not named in the hearing.
Senior Coroner Alison Mutch expressed concern over the time it had taken to reach that point. In particular, she said the fact the case spent five weeks with a GMP unit whose sole task it was to examine prosecution files 'beggars belief..'
Mr Matley's brother was present in court and Ms Mutch said: "I am just so sorry that you are sat here nearly a year after your brother's death and you still don't know if there's going to be a prosecution."
However, the court was told the CPS had 'expedited' the case. Sergeant Matt Waggett from the SCIU said: "The decision is imminent and is expected in the next few days."
Senior Coroner Alison Mutch said the decision on whether the inquest process could proceed or would need to be suspended, hinged on the CPS's decision
