A dad whose baby son died in a bathtime drowning tragedy has vowed to get justice after winning the right to sue Scotland’s biggest council for compensation.
Ten-month-old Logan Cruickshanks was living with his grandmother Agnes Kerr when he lost his life in August 2018 – having been placed there by Glasgow City Council as part of a kinship arrangement.
But he died while being given a bath by his aunt Kayleigh Kerr, 25, who was living at the same address in Easterhouse.
She stood trial at the High Court in Glasgow in September 2022 for culpable homicide but was found not guilty and cleared of having responsibilty for his death.
Dad Tommy, 28, told the Sunday Mail he has now raised court action.
He said: “I won’t stop until someone is held responsible. Glasgow City Council did not carry out the proper assessments that I asked for.
“I said from day one he was not safe.”
Tommy raised an action at the Court of Session in Edinburgh for compensation over his son’s death, holding the local authority social work department responsible.
Glasgow City Council had asked at the same court that the compensation claim be thrown out.
But last week judge Lord Weir gave the father the green light for the action to be heard.
Eights days have now been set aside for the case in November this year.
Tommy ended up in hospital and was diagnosed with PTSD and anxiety disorders.
He added: “It has impacted me right up to this day.”
Kayleigh Kerr had been accused of leaving her nephew unattended in his plastic bath seat as she ran a bath for him before they were due to go out, checking on him sporadically.
At her last check, she found Logan “submerged”. She carried him to her mother’s bed to administer mouth-to -mouth resuscitation.
