Kakao has been raided by South Korean authorities over allegations that it was involved in stock manipulation over its purchase of SM Entertainment shares.According to a report by English South Korean publication Korea JoongAng Daily, about 40 prosecutors and investigators from the Financial Supervisory Service (FSS) – the East Asian country’s financial regulator – had confiscated data from Kakao’s office in the city of Pangyo in relation to its stock trading activity from February 2023.“The special judicial police at the FSS is presently in the process of investigating if the sale of SM shares is in violation of the Capital Markets Act under guidance from the prosecution,” an FSS spokesperson said in a statement to South Korean press, per Korea JoongAng Daily.“The team is looking into whether there was artificial engagement to sway share prices in a certain direction,” they added.Per The Korea Herald, Kakao are reportedly under investigation for allegedly artificially inflating the stock price of SM Entertainment in an attempt to block HYBE from taking control of the K-pop agency.Back in February, HYBE had launched a tender offer to buy up to 25 per cent of SM Entertainment for ₩150,000 per share. However, HYBE had only been able to acquire 0.98 per cent through that offer, per The Korea Herald.Around the same time, HYBE had submitted a petition to the FSS over an “abnormal” 2.9 per cent purchase of SM Entertainment stocks that had been transacted through a IBK Securities’ branch in Pangyo, according to Korea JoongAng Daily.Kakao has yet to comment on the situation. NME has reached out for comment.Meanwhile, HYBE has since dropped its bid to acquire SM Entertainment following a discussion with Kakao.

A US judge last week dismissed a song theft lawsuit filed against Childish Gambino which claimed that his 2018 hit ‘This Is America’ ripped off an earlier track called ‘Made In America’.The choruses of the two songs are not “substantially similar”, despite what that lawsuit claimed, the judge ruled, while the “distinctive flow” of the earlier work is not protected by copyright.Miami-based rapper Kidd Wes – real name Emelike Nwosuocha – sued Childish Gambino – aka Donald Glover, of course – in 2021, claiming that ‘This Is America’ lifted from his 2016 release ‘Made In America’.“The distinctive flow” heard in Glover’s track, the lawsuit stated, “is unmistakably substantially similar, if not practically identical, to the distinct and unique flow that was employed by Nwosuocha in recording his vocal performance of his rapping of the hook to his copyrighted work”.“The lyrical theme, content, and structure of the identically-performed choruses are also glaringly similar”, the lawsuit then added.Glover responded to the lawsuit last September seeking to have Nwosuocha’s legal action dismissed.

2021 lawsuit against Childish Gambino (Donald Glover) over the alleged copyright infringement of ‘This Is America’ has officially been dismissed.Late last week, Manhattan judge Victor Marrero dismissed Kidd West’s (real name Emelike Nwosuocha) lawsuit, saying his 2016 track ‘Made In America’ was “not substantially similar” to Childish Gambino’s hit 2018 track ‘This Is America’, per a Billboard report.Documents from the lawsuit – filed in 2021 – saw Nwosuocha seeking a trial and damages from profit for the alleged infringement across 43 categories, including record sales, downloads, streaming revenue, merchandising and more.“A cursory comparison with the challenged composition reveals that the content of the choruses is entirely different and not substantially similar,” judge Marrero said, also noting that Nwosuocha’s lyrics were deemed a “short, simple, self-aggrandizing proclamation” while Glover’s lyrics were based on “what America means and how it is perceived,” ruling out any similarity based on lyrics.Judge Marrero also pointed out that Nwosuocha had failed to obtain a compositional copyright registration: “Even if Nwosuocha had a copyright registration for the composition of Plaintiff’s Composition, however, dismissal would be warranted here because the elements of Plaintiff’s Composition purportedly infringed upon are insufficiently original to warrant protection, or because they are not substantially similar to the Challenged Composition”.“More could be said on the ways these songs differ, but no more airtime is needed to resolve this case,” judge Victor Marrero added.Nwosuocha’s attorneys, Imran H.
