Judges in Manchester have freed defendants accused of serious crimes from prison as the criminal justice system reaches crisis point. An alleged rapist, two men accused of causing grievous bodily harm and an alleged sexual offender were released on conditional bail as the barristers strike continues.
Under the law defendants can be held in custody for almost six months after being charged, while awaiting their trial. Judges often allow prosecutors to extend the amount of time a defendant remains in custody awaiting trial if there is a 'good and sufficient' reason.
But in recent cases, three judges across Greater Manchester and Bolton have refused to extend the period, known as 'custody time limits'. Trials in all three cases had been due to take place this month, but had to be abandoned because the defendants had no lawyer to represent them due to barristers taking industrial action in a row over Legal Aid, the scheme which pays lawyers for publicly funded work.

Barristers have been taking part in action all summer in phased periods in protest over Legal Aid fees, but since September 5 the vast majority of criminal defence lawyers have launched an indefinite strike. The Criminal Bar Association, which represents barristers, has argued for an immediate 25 per cent increase, while the Government has offered 15 per cent. The action, which barristers maintain is necessary to secure the future of the profession, has had a huge impact in Manchester's crown courts, with cases regularly being adjourned due to a lack of a defence lawyer.
