Humza Yousaf will be advised by senior SNP allies to reject any appeal of the Government’s humiliating court defeat on his gender reform law.
Top party figures who supported the new law believe the game is up and will urge the First Minister to blow no more public cash on the case.
The SNP Government suffered a humbling defeat in the Court of Session after a judge ruled Westminster had acted lawfully by blocking Holyrood’s Gender Recognition Reform (GRR) Act.
SNP ministers have already racked up a legal bill of around £230,000 fighting the case and costs could spiral if they appeal.
A senior party figure said Yousaf would be advised by his supporters to call it quits: "We have done our best with this. Times move on and we have a new First Minister."
The insider agreed GRR is a “Nicola Sturgeon legacy issue” and said: “There are some people who just think there is no point in appealing.”
The source said walking away before Christmas would be the best course of action as it would allow Yousaf to start afresh in the New Year.
The legal row began when Holyrood passed the GRR Bill with cross-party support in December last year.
The legislation was aimed at making it easier for Scots to change their legally recognised gender.
But it was blocked by Alister Jack, the Scottish Secretary, who issued a rare Section 35 order in January.
The Tory minister claimed the gender reforms were incompatible with UK-wide equality laws - an argument furiously rejected by the Scottish Government.
Nicola Sturgeon, the then first minister whose Government backed the law, described Jack’s decision as an assault on devolution.
