Todd Spangler NY Digital Editor Amazon agreed to pay a $25 million civil penalty as part of a settlement with the Justice Department and the FTC to resolve allegations the ecommerce giant’s Alexa voice assistant violated a U.S. children’s privacy law, the DOJ announced. Under the terms of the settlement, Amazon also is required to change its practices relating to the alleged violations and inform consumers of its practices. According to a complaint filed in May by the DOJ on behalf of the FTC, Amazon prevented parents from exercising their deletion rights under the Children’s Online Privacy Protection Act Rule (COPPA Rule) and kept sensitive voice and geolocation data for years and used it for its own purposes “while putting data at risk of harm from unnecessary access.”
Since May 2018, the U.S. government alleged in a lawsuit filed in federal district court in Washington, Amazon’s Alexa-related offerings have included voice-activated products and services directed toward children under 13 years of age — in violation of COPPA, the COPPA Rule and the FTC Act. When a user makes a verbal request of an Alexa-enabled device, Amazon saves the voice recording of the request and creates a written transcript of it. The complaint alleged that Amazon retained children’s voice recordings indefinitely by default, in violation of COPPA’s requirement that these recordings be retained only as long as “reasonably necessary” to fulfill the purposes for which they were collected. Other alleged violations include Amazon making deceptive representations that Alexa users could delete their or their children’s voice recordings — including audio files and transcripts and their geolocation information — when in fact Amazon on some occasions

Todd Spangler NY Digital Editor The FTC is looking into whether OpenAI, the developer of the artificial-intelligence chatbot ChatGPT, “engaged in unfair or deceptive privacy or data security practices or engaged in unfair or deceptive practices relating to risks of harm to consumers, including reputational harm,” according to a letter the regulatory body sent to the company. The agency’s probe into OpenAI was first reported by the Washington Post, which shared a redacted copy of the letter to the company (at this link). The time period for the FTC’s information requests to San Francisco-based OpenAI date from June 1, 2020, “until the date of full and complete compliance” with the investigation, which is technically called a “civil investigative demand” (CID).

The start-up, which plans to ship some 500,000 free, ad-supported TVs in 2023 in the U.S., is calling the initial wave a “public beta program.” The company says the new Telly households represent a diverse cross-section of the U.S. population, although the initial user base overindexes on education level and household income — and also skews toward Gen Zers and millennials. According to Telly, more than 250,000 people have signed up to receive a free TV set, which displays an always-on, rotating ad unit on a 9-inch-high second screen situated below the main 55-inch one. Each unit also includes a free Chromecast with Google TV adapter. The bulk of the half-million TVs will go out in the fourth quarter of 2023, Telly chief strategy officer Dallas Lawrence said: “We think there’s no better Black Friday deal than free.”
