At a virtual hearing on Thursday, 9 March, which Baldwin did not attend, a New Mexico court heard that the firearm that killed cinematographer Halyna Hutchins had since been destroyed by the state. Baldwin previously pleaded not guilty to two counts of involuntary manslaughter over the fatal shooting of Ms Hutchins on the Rust movie set in October 2021.

The gun that killed Rust cinematographer Halyna Hutchins in October 2021 has been “destroyed,” a lawyer for Alec Baldwin revealed today.

Alec Baldwin's lawyer told a judge Thursday the "30 Rock" actor "wants his day in court," and revealed the gun used in the fatal "Rust" shooting has been destroyed by the state.  Baldwin previously pleaded not guilty to two counts of involuntary manslaughter in the death of cinematographer Halyna Hutchins. He was charged in January, more than a year after the fatal shooting on the "Rust" film set.

Rust crew members sued Alec Baldwin and the film’s producers on Monday, alleging they suffered symptoms of insomnia, post-traumatic stress disorder, and anxiety stemming from the fatal shooting of the film’s cinematographer, Halyna Hutchins, according to a lawsuit obtained by ET. The three crew members claim they were in the church building during filming, when Baldwin’s gun went off, striking Hutchins and director Joel Souza. Baldwin, who denied pulling the trigger, has been charged with two counts of involuntary manslaughter after the gun he was holding discharged, killing Hutchins and wounding director Souza on the Western film set in New Mexico.Last week, Baldwin formally entered a not-guilty plea to the manslaughter charge.

Alec Baldwin and "Rust" movie productions were named in a negligence lawsuit filed by three former crew members who say they witnessed the on-set shooting death of cinematographer Halyna Hutchins. The plaintiffs in the latest suit are Ross Addiego, the dolly operator, Doran Curtin, the set costumer, and Reese Price, the key grip. According to the suit, all three were in close proximity to Baldwin when the gun was fired, and suffered “blast injuries” from the deafening sound of the shot.

The production company behind the film Rust has agreed to pay a fine of 100,000 US dollars to the New Mexico Environment Department’s Occupational Health and Safety Bureau (OHSB) following the fatal shooting of cinematographer Halyna Hutchins on October 21, 2021, The bureau issued a fine of 136,793 US dollars (£104,810) to the production company last April, the maximum allowable by state law in New Mexico. Under the settlement, which is pending approval, the bureau downgraded its claim from “wilful-serious” to a “serious” violation.

Rust Movie Productions was scheduled to challenge the citation at a state commission hearing in June. Under the settlement, the state agency agreed to the reduced penalty and dropped its claim that the production committed a “willful” violation of safety rules. A “willful” citation is the most severe under OSHA’s enforcement system.
