Private landlords are mounting a legal offensive against the Scottish Government over a rent rise cap.
The Scottish Association of Landlords yesterday (Friday) submitted a petition for a Judicial Review of a decision to peg rent rises at three percent and maintain an eviction ban.
The SAL had hoped to persuade Scotland’s tenants’ rights minister Patrick Harvie to soften on plans to allow just a three per cent increase in rents.
But the minister held firm by announcing that the cap will be in place until September at the earliest, to protect tenants during the cost of living crisis.
John Blackwood, chief executive of the Scottish Association of Landlords (SAL), said: “Landlords selling up loss making property is further reducing housing supply, despite ever increasing demand. The result is the cost of finding a new home is actually increasing for renters.
“While the Scottish Government sees fit to raise council and housing association tenants’ rents, so social landlords can do repairs and improvements, they fail to realise that private landlords are faced with similar financial pressures.”
He added: “Landlords have had enough. We must stand united to protect our property rights by challenging this unfair legislation in court.”
Many landlords claim they have been hammered by fast rising interest rates and are now being forced to sell properties to avoid financial disaster.
They claim the measures will effectively push rents higher, as less and less property will remain in the private rented sector due to forced sales.
The legal action, in conjunction with Scottish Land & Estates and PropertyMark, the professional body for property agents, claims that landlords’ human rights are being breached.
