UPDATED with latest: A Los Angeles Superior Court judge on Tuesday ruled that Rust script supervisor Mamie Mitchell can pursue her negligence and other claims against Alec Baldwin, who fired a loaded gun on the New Mexico set of the indie Western last year that killed cinematographer Halyna Hutchins and wounded director Joel Souza.

It’s been more than a year since the tragedy on the western Rust which saw DP Halyna Hutchins’ life taken after a prop gun, handled by pic’s star and producer Alec Baldwin misfired, also injuring the director Joel Souza; and the Santa Fe Sherriff’s Department has finally concluded its investigation and sent it over to the New Mexico District Attorney Mary Carmack-Altwies who is reviewing details for potential further charges.

The late cinematographer Halyna Hutchins was remembered today on the one-year anniversary of her death on the set of the film Rust.

Alec Baldwin's controversial movie Rust will resume production in January. In October 2021, production on the western was suspended indefinitely after Baldwin's prop firearm discharged during a rehearsal, injuring director Joel Souza and killing cinematographer Halyna Hutchins. Her family filed a wrongful death lawsuit over the incident in February, and on Wednesday, it was announced that all parties had reached a settlement, which involves Hutchins' husband Matthew boarding the project as an executive producer.

"The proposed settlement announced today in Matthew Hutchins’ wrongful death case against ‘Rust’ movie producers, including Alec Baldwin, in the death of Halyna Hutchins will have no impact on District Attorney Mary Carmack-Altweis’ ongoing investigation or her ultimate decision whether to file criminal charges in the case," Heather Brewer, spokesperson, Office of the First Judicial District Attorney, State of New Mexico, told Fox News Digital.  "While civil suits are settled privately and often involve financial awards, criminal cases deal only in facts. If the facts and evidence warrant criminal charges under New Mexico law then charges will be brought.
